1. Acceptance of Terms
By accessing or using racecast.io (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Service. These Terms apply to all visitors, users, and premium subscribers.
2. Description of Service
Racecast.io is a race weather forecasting platform that provides weather forecasts, course analysis, pacing recommendations, nutrition guidance, gear suggestions, and mental strategy content for runners preparing for race day. The Service includes both free and paid (“Premium”) features.
3. Premium Purchases
Premium Race Plans are available as a one-time purchase for the current edition of a specific race. By completing a purchase, you acknowledge and agree to the following:
- Premium content is delivered immediately upon purchase as digital content. Because of the time-sensitive nature of race forecasts and the immediate delivery of personalized content, all sales are final and non-refundable.
- Your purchase grants access to the Premium Race Plan for a single race edition (identified by race and year). It does not carry over to future editions of the same race.
- Payments are processed by our third-party payment provider, Dodo Payments. Your payment is subject to their terms and conditions in addition to these Terms.
- We reserve the right to change pricing at any time. Any price changes will not affect purchases already completed.
4. Important Disclaimers
Please read this section carefully. It limits our liability to you.
4.1 Weather Data
Weather forecasts displayed on the Service are sourced from third-party providers including Visual Crossing and Open-Meteo. Weather data is provided “as-is” and “as-available.” We do not guarantee the accuracy, completeness, or timeliness of any weather forecast. Weather conditions can change rapidly and without warning. Always check official sources and use your own judgment on race day.
4.2 Not Professional Advice
All content on the Service — including but not limited to pace recommendations, nutrition guidance, carb-loading plans, hydration strategies, gear suggestions, and mental coaching cues — is provided for informational and educational purposes only. This content does not constitute professional medical advice, nutritional counseling, athletic coaching, or any other form of professional guidance.
You should consult with a qualified healthcare provider, registered dietitian, or certified running coach before making decisions about your training, nutrition, or race-day strategy. Never disregard professional medical advice or delay seeking it because of information provided by the Service.
4.3 Assumption of Risk
Running and racing carry inherent risks including, but not limited to, physical injury, illness, and adverse reactions to weather, altitude, nutrition, or exertion. By using the Service, you acknowledge that you are solely responsible for your own health, safety, and race-day decisions. Racecast.io is not responsible for any injury, illness, or loss that may result from your use of the information provided through the Service.
4.4 AI-Generated Content
Certain content on the Service, including weather narratives and race summaries, is generated using artificial intelligence. While we strive for accuracy, AI-generated content may contain errors or inaccuracies. AI content should be treated as a convenience tool, not as authoritative guidance.
5. User Accounts & Content
You may create an account to access community features such as posts, comments, and race ratings. You are responsible for maintaining the security of your account and for all activity under your account. You agree not to post content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.
We reserve the right to remove any user-generated content at our sole discretion and without notice.
6. Intellectual Property
The Service, including its design, code, data models, race analysis algorithms, and original content, is owned by racecast.io and protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from the Service without prior written permission.
You retain ownership of any content you post through the Service. By posting content, you grant racecast.io a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content in connection with the Service.
7. Limitation of Liability
To the fullest extent permitted by law, racecast.io and its owner, operators, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use of or inability to use the Service;
- Any inaccuracy in weather forecasts, pace recommendations, nutrition guidance, or other content;
- Any injury, illness, or adverse outcome related to your use of information from the Service;
- Any unauthorized access to or alteration of your data;
- Any other matter relating to the Service.
In no event shall our total liability to you exceed the amount you have paid to racecast.io in the twelve (12) months preceding the event giving rise to the claim.
8. Indemnification
You agree to indemnify, defend, and hold harmless racecast.io, its owner, operators, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any rights of another party.
9. Disclaimer of Warranties
The Service is provided on an “as-is” and “as-available” basis. Racecast.io makes no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any forecasts or recommendations will be accurate.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Massachusetts.
11. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be posted on this page with an updated “Last updated” date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
